Terms of Service
As the Hirer, it is your responsibility to read, and fully understand, the terms and conditions outlined below before making a booking from us (THE MOMENTS). Please contact us if you need clarification.
All equipment is used at the user's own risk. It is the Hirer’s duty to ensure the equipment is used safely and that all guidelines are followed to protect everyone involved.
Please note that our company is not liable for any damage or injury that may occur while the equipment is in use, regardless of the cause.
Terms of Payment

To secure a booking, a $100 deposit is required. We require that you accept the Terms of Service, and all rental rules provided to you. The remaining balance must be paid 3 days before the event.

THE MOMENTS reserves the right to cancel any bookings if payment is not made within the time frame stipulated.
Hire Period

The standard rental period is 4 hours, unless noted otherwise. There is an allowance of 2 hours for set-up and pack-down.

Late returns will incur a charge of 25% of the total hire cost for every hour that goods are returned after the arranged return time.
Item Availability

If your chosen equipment becomes unavailable due to damage during a prior booking (and cannot be replaced with an identical item) you will be entitled to either select another item of equipment, receive a full refund, or receive a credit with us. While we will do everything in our power to repair or replace any damaged equipment we cannot guarantee it will be available and do not accept any liability if it is not.
Delivery and Collection

For bookings which include delivery and set up, delivery is included within 10km of Halswell, Christchurch. Additional cost applies for delivery further than 10km from Halswell – TBC.

Pick up is from Halswell, Christchurch

For delivery, set-up, and collection by us, unless arranged otherwise, we require 60 minutes prior to the event for equipment set up at your venue and 60 minutes after the event for pack-down. ​

THE MOMENTS must receive prior authorisation from the hirer to enter the delivery site and shall not be held accountable for any damage caused to driveways, buildings, property or equipment during delivery and collection of goods.

After the event, please ensure all equipment is in the same condition as it was originally set-up. Ball pit balls must be kept inside the ball pit. Otherwise, an additional fee may apply.

We cannot be held responsible for delays caused by circumstances beyond our control, such as traffic congestion, adverse weather, or other unforeseen events.

It is the Hirer’s responsibility to ensure the venue is easily accessible for unloading and loading equipment. We must be informed in advance of any access limitations, such as restricted parking, stairs, narrow doorways, or other obstacles. Failure to notify us may result in setup delays, additional charges, or cancellation of your booking.

Delivery and collection times are specified and agreed to by both parties. The hirer, (or a trusted nominated person) must be present during delivery and collection of hire items unless a prior arrangement has been agreed upon.

Any equipment belonging to THE MOMENTS is not to be removed from the delivery site, and is not to be disassembled after hire unless authorisation has been granted by THE MOMENTS. This is the duty of our staff to prevent damage to our equipment and minimise safety risks.

The customer is in no way permitted to sublet, lend or sell THE MOMENTS equipment.
Site / Venue Requirements

It is the responsibility of the hirer to ensure the site or venue is ready prior to delivery of goods. THE MOMENTS will not be responsible for clearing obstructions in order to place equipment. Hire may be refused if we deem the site (or access to) unsafe or unsuitable.

The hirer is responsible for gaining permission to use the hired equipment at the venue.

It is up to the hirer to gain council approval for the use of public spaces.

Our equipment shall not be set up on sites that are wet, sloping, muddy, rough/rocky, or on other surfaces that are likely to cause damage to our equipment or compromise the safety of users.

All Inflatable equipment require access to a power point that is within a 10m distance from where the inflatable will be set up.

There must be at least 1 meter clearance on each side of inflatables to prevent damage to property and to allow staff to set up and packdown safely and efficiently.

At no stage are any equipment to be used with water. This means no hoses or other water sources.

Weather
-
All hired equipment must be used outdoors only in dry, still conditions and kept out of direct sunlight. We are unable to set up if rain and strong wind are forecast.

We recommend that you always have a back-up indoor venue in case of bad weather. Please note, we do not offer refund due to weather conditions.
Handling and Care of Equipment

The hirer is responsible for all THE MOMENTS hire equipment from the time it is released, to the time it is returned. Equipment that has been hired from THE MOMENTS is to be returned clean, dry, undamaged and in the packaging in which it was received.

The hirer must take care to prevent damage at all times when using and transporting THE MOMENTS hire equipment. This includes supplying blankets, tie downs, or tarpaulins as necessary to protect items from damage. THE MOMENTS will not release goods to the hirer if suitable transportation methods are not evident.

In the event a customer has been granted overnight use of our equipment, we expect that it will be stored indoors or undercover to prevent damage from dew, moisture, or other.

Facepaint, shoes (notably high heels), food and beverages can cause irreparable damage to our inflatable and soft play mats and equipment. As such, the hirer must ensure adherence to correct user guidelines at all times. Stains or marks as a result of misuse or deliberate ignorance of our guidelines by the hirer will incur a cleaning fee of up to $200.
Bond

All bookings will incur a bond as set out in the hire agreement. The bond will be refunded within 3 days after the event, provided all items are returned in good condition, undamaged, and clean.

You will be held liable for any damage to or loss of hired items. The cost of any damage or loss will be deducted from your bond. If the total exceeds the bond, you will be invoiced separately for the remaining amount, which must be paid in full within 7 days of receiving the invoice.

If equipment is damaged beyond repair the hirer will be charged for the replacement of that piece of equipment. If you would like to know the replacement costs for hire items, please contact the THE MOMENTS.
Lost | Stolen goods

In the event of THE MOMENTS equipment being stolen, the hirer will be responsible for the full replacement cost of the stolen equipment.

We expect that lost equipment is brought to the attention of THE MOMENTS staff as soon as possible. The hirer will be responsible for full replacement costs of any lost equipment.

THE MOMENTS will not be held accountable or liable for any costs/penalties incurred by the hirer as a result of equipment causing obstruction. This includes local authority fines, towage fees, seizure, or impoundment costs whilst in the care/use of the hirer.
Safety Requirements
• Children must be supervised when using out equipment at all times. At no stage are children allowed to tamper with any electrical equipment supplied.
• Children are not to climb on or over walls of the inflatable equipment and adults are not permitted to jump on bouncy castles as they are not designed for adult use.
• THE MOMENTS will clearly state age suitability based on manufacturer specifications for all hire equipment. It is the customer’s responsibility to ensure that items hired are suitable for the age and skills of the users. THE MOMENTS will not be held liable for any injury as a result of negligence to comply with safety guidelines.
• THE MOMENTS does not allow the use of the customer’s personal electrical equipment (other than power supply point & extension cord).
